1. ACCEPTANCE OF TERMS

By accessing, installing, registering for, or using "Other Me" ("Platform" or "Service"), you ("User", "you", or "your") agree to be legally bound by this End User License Agreement (EULA), as well as our Privacy Policy and Terms of Service.

If you are a parent or legal guardian registering a sub-account for a minor, you are fully responsible for that sub-account's use and consent to this agreement on their behalf.

If you do not agree with this EULA, you must not use the platform.

2. LICENSE GRANT

We grant you a limited, non-exclusive, non-transferable, revocable license to use "Other Me" solely for your personal or professional use in accordance with this agreement.

You may:

  • Access and use the AI assistants via our platform
  • Customize and personalize AI assistants within the scope of platform settings
  • Interact with assistants for supported personal or work tasks
  • Connect third-party tools and services via supported integrations

You may not:

  • Reproduce, copy, resell, sublicense, or distribute the platform or its outputs
  • Reverse engineer, decompile, or attempt to extract source code or models
  • Use the service for unlawful, deceptive, or abusive activities
  • Circumvent or disrupt security, authentication, or usage controls
  • Use the platform for competitive product development or AI model training

3. ACCOUNT RESPONSIBILITIES

To use the platform, you must create an account with accurate and complete information.

You are solely responsible for:

  • Maintaining the confidentiality of your credentials
  • Ensuring the security of your devices
  • All activities that occur under your account or any linked sub-account

We are not liable for unauthorized access unless it results from our direct breach of duty.

4. SUB-ACCOUNTS & PARENTAL CONTROLS

The platform permits creation of sub-accounts for users under 16 years of age, subject to the following:

  • Only verified parents or legal guardians may create and manage such accounts
  • The parent/guardian assumes full control and responsibility for sub-account usage
  • Parental controls include assistant restrictions, time limits, content filters, and full access to chat history

By registering a sub-account, the parent/guardian:

  • Accepts this EULA on behalf of the child
  • Consents to the collection and processing of personal data required for the assistant experience
  • May delete or modify data at any time via the control dashboard

5. ACCEPTABLE USE RESTRICTIONS

You agree not to use the platform to:

  • Generate or engage in hate speech, harassment, defamation, or abuse
  • Promote or facilitate self-harm, violence, terrorism, or criminal acts
  • Create deepfakes or impersonations without consent
  • Disseminate false or misleading information
  • Attempt to manipulate or bypass system limitations
Violation of this section may result in immediate account suspension or termination without refund.

6. AI BEHAVIOR AND LIMITATIONS

The "Other Me" platform utilizes AI models to simulate conversation, provide suggestions, and assist with tasks. You acknowledge and agree that:

  • AI assistants are not real humans, and their responses are simulated
  • Assistants may generate incorrect, biased, or inappropriate outputs
  • They are not substitutes for professional advice (e.g., medical, legal, or financial)
  • You use the assistant's advice and responses at your own discretion and risk
In case of emotional distress or crisis, always consult a qualified human professional.

7. DATA STORAGE, MEMORY & CUSTOMIZATION

The platform stores interaction history and preferences to enable personalized experiences.

You acknowledge that:

  • Your assistants may adapt behavior based on historical interaction
  • Memory and personality settings are stored securely and can be cleared via account settings
  • Sub-account activity is visible to the parent/guardian administrator
  • Your data is governed by our Privacy Policy, which complies with GDPR and global standards

8. INTELLECTUAL PROPERTY RIGHTS

All rights, title, and interest in the platform, including software, AI assistant logic, UI components, media, and trademarks, are the exclusive property of Pop Hasta Labs or its licensors.

You are granted no ownership or rights except the limited license described above. You may not use our platform or content to train any other AI models or services.

9. THIRD-PARTY SERVICES

Our service integrates with third-party services including, but not limited to:

  • OpenAI / Anthropic / LLM Providers (for generating assistant responses)
  • Stripe (for secure payments)
  • Google APIs (for integrations with Gmail, Docs, Sheets, etc.)

You acknowledge and agree:

  • These third parties may collect and process your data in accordance with their own policies
  • We are not responsible for their performance, terms, or data use

10. FEES, PAYMENT & REFUND POLICY

Access to some features of "Other Me" requires a paid subscription.

By subscribing, you agree:

  • To be billed on a recurring basis (monthly, unless stated otherwise)
  • Charges will be handled securely via third-party processors (e.g., Stripe)
All payments are final — no refunds will be provided, including for:
  • Partial use
  • Unused time
  • User dissatisfaction
  • Account suspensions due to policy violations

You may cancel your subscription anytime through your dashboard. Your access will continue until the end of your billing period.

11. TERMINATION

We reserve the right to suspend or terminate your access at any time if:

  • You violate this agreement or our policies
  • You engage in harmful, illegal, or unethical activity
  • Required by law or court order

Upon termination:

  • Your license to use the platform ends
  • Stored data may be deleted (unless legally required otherwise)
  • You are not entitled to a refund

12. DISCLAIMER OF WARRANTIES

The platform is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

  • Non-infringement
  • Fitness for a particular purpose
  • Accuracy, availability, or reliability of outputs

We do not warrant that:

  • The platform will be uninterrupted or error-free
  • Outputs will be accurate or applicable to your situation
  • Integrations will remain compatible over time

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Pop Hasta Labs shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Lost profits, loss of data, business interruption
  • Actions taken based on AI suggestions or responses

Our total liability under this agreement shall not exceed the fees you paid in the past six months.

14. INDEMNIFICATION

You agree to defend, indemnify, and hold Pop Hasta Labs harmless from and against all claims, liabilities, damages, and expenses (including legal fees) arising out of or related to:

  • Your use of the platform
  • Violation of this EULA or any applicable laws
  • Content generated or shared through your account

15. GOVERNING LAW & DISPUTES

This agreement shall be governed by and construed under the laws of England & Wales, without regard to conflict of law principles.

Disputes that cannot be resolved informally shall be settled by:

  • Binding arbitration, or
  • The courts of England & Wales

16. CHANGES TO THIS AGREEMENT

We may update this EULA periodically. Changes become effective once posted on the platform. We may notify users of significant changes via email or in-app alerts.

Continued use of the platform constitutes acceptance of the updated terms.
